We are transparent
This agreement ("Agreement") between Katya IT Solutions LLP, ("We") and Customer governs the provision of Katya It Solutions LLP's cloud and related services (the "Services"). This Agreement is effective once Customer signs up for Services through the computefox.com website or visits the website computefox.com. By signing up, each customer agrees to comply with the terms of service listed below.
It might take upto 72 working hours to active the service after paying the invoice in full. Any account may take more time to be activated if it fails the initial verification. In that case, we will contact you with details and steps to complete the verification process. The service will not be activated on failing to complete the verification process.
You agree to pay for the Services on time and in advance for the billing cycle Services are provided for. We will terminate the service if the invoice is not paid within due date. Invoices that have been paid more than once because of multiple PayPal subscriptions or 2checkout subscriptions or multiple manual payments, cannot be refunded. The overpaid amount will be added as credit to your account which can be used to pay for future invoices.
Customer agrees to keep his contact information and e-mail on file up to date at all times. We will use the e-mail on file to send notifications about generated invoices, due invoices, Services suspension, Services termination, new Services provisioned,offers and any other related information. We recommend using an external e-mail address so that the Customer can receive messages in case there are problems with the Services.
Customer is responsible for the content uploaded to account. Customer is responsible for the actions of customers using accounts within our servers and network. In case Katya IT Solutions LLP's terms of service are violated, we will suspend the account violating the terms and will notify the Customer via the e-mail on file. We will not be held responsible for any harm or damage caused by the use of our services. Customer agrees to use the Service in his/her own risk.
You may ask for money back with a proper reason. We will process the money back if we are not able to fix that issue.
Customer agrees to use the Services for lawful purposes only. Following content on our servers and network are prohibited. Anything related to IRC Proxy Scripts, Anything related to torrents, Starting background processes on shared servers, Warez, hacking tools, exploits Porn web sites, Download oriented web sites, Sites promoting illegal activities and/or terrorism, IP Scanners Hacker focused, crawling, sites Consumes unexped resources. Unused files Any account found to be in violation of anothers copyright will be expeditiously removed, or access to the material disabled. Any account found to be in repeated violation of copyright laws will be suspended and/or terminated from our hosting. Customer agrees not to use shared services as a storage for backups. If we find backups stored in your account they will be removed automatically. Customer is responsible to keep their accounts up to date and secure at all times. Directories must be chmod to 711 and configuration files with passwords must be chmod to 600. Scripts, plugins, modules need to be kept up to date at all times. A strong password must be used. Customer can not host image , video streaming , audio stream sites.
Fail usage policy is applicable for all unlimited resource usage. Your account might be suspended if its creating issue for other customer or using an unusual resources.
We keeps backup of all files and databases if a customer purchased the backup service or if backup is included by default with the service purchased. Customer agrees to use Katya IT Solutions LLP's backup service on his own risk. Katya IT Solutions LLP doesn't guarantee the existence of backups at all times and recommends the Customer to store their own backups at all times.
We do free transfers of accounts you want moved to our servers from providers which use cPanel. We do not guarantee the quality of such transfers and you must verify if your account was moved correctly before you change the nameservers. If something is wrong with the account after the move and it wasn't moved correctly it is your responsibility to fix it. In 99% of the transfers there are no problems but we do not guarantee that.
We need justification in order to assign extra dedicated IP to the service. Valid justification is SSL installation or installation of a service that requires to listen on a separate IP address.
We have a zero tolerance against SPAM. Accounts used to send SPAM will be suspended immediately. If the SPAM sending is repeated the account will be removed from our server. We do not allow bulk mailing from our servers. Purchased mail lists, opt-in lists will be considered SPAM. We reserve the right to charge a clean up fee to the Customer who sent unsolicited e-mail which caused the IP of our server to be blacklisted for sending SPAM.
Any account cannot use more than the expected CPU or memory resources. If the usage is too high to keep the server stable, we will suspend the overloading account so that it doesn't affect the other clients on the server
There is no guarantee that we will provide the custom requested plan. Its completely depends on the availability.
Customer agrees that any claim or dispute you may have against Katya IT Solutions LLP must be resolved by a court located in Chandannagar, Dist : Hooghly, State : West Bengal, Country : India. You agree to submit to the personal jurisdiction of the courts located within Chandannagar, Dist : Hooghly, State : West Bengal, Country : India for the purpose of litigating all such claims or disputes. This Agreement shall be governed by the laws of India, without giving effect to any principles of conflicts of law.
Katya IT Solution LLP reserved the right to send multiple (maximum upto 10 emails and 5 SMS for each invoice) payment reminders for unpaid invoices.
Depending on market trends, we reserved the right to change/deprecate any package. On this situation, all existing package will be upgraded/downgraded to new or nearest package depending on customer's usage or as per our decision.
Domain availability and registration completely depends on registry. We check with the registry for the domain availability and after making the payment we send a second request to register the domain. A full refund of the domain cost will be processed if the domain registration failed for any reason.
Katya IT Solutions LLP reserves the right to make changes to the terms at any time without notification. Customer agrees to visit the terms of service regularly for updates.
